Only licensed brokers can put a home on the MLS, so every "flat fee MLS" or "low commission" option in Alabama ends with a licensed broker entering your listing. What differs is how many companies stand between you and that broker, and who gets paid along the way. This guide explains the three common models, shows how Flat Fee Group works in Alabama with broker Tracy Hood of Amerisell Realty, and lists the questions to ask before you sign.

The three models

1. Direct flat-fee MLS broker. You sign a listing agreement with a licensed broker, who enters your home on the MLS, makes your listing changes and takes your calls. Flat Fee Group works this way. It is a national co-op of direct flat-fee MLS brokers, with one licensed broker per state.

2. Marketplace or technology platform. A national website takes your order and payment, and a licensed broker in your market places the listing. Houzeo is an example. Its Terms of Use describe it as "a technology platform connecting consumers with licensed real estate brokers" that "does not provide brokerage services or act as a real estate broker." Houzeo Corp. lists a brokerage license in Alabama, and its terms say its brokerage entities "may receive referral fees."

3. Agent-referral company. A referral company matches you with a traditional agent who has agreed to a discounted rate, and the agent pays the company part of the commission. Clever Real Estate is an example. Its terms state, "CLEVER IS MERELY A REFERRAL SERVICE," and its FAQ says it "earns a referral fee from the agent's commission when a transaction closes."

Why the model matters

  • One point of contact. When the company you paid isn't the broker holding your listing, a simple request like "Can you lower my price today?" may pass through a support queue first. With a direct broker, the person you call can make the change.
  • Faster listing updates. Price changes, new photos and status updates affect buyer traffic. A direct broker controls your MLS entry and can act right away.
  • Help through closing. Offers, counteroffers and closing paperwork go through the listing broker. Working with that broker from day one means the person who knows your listing is still with you at closing.
  • Where the money goes. Referral fees are legal and common, but someone builds them into the price. Clever's broker agreement describes its fee as "a portion of the gross commission" on sales that close within two years of the referral.

Frequently asked questions

Do all flat fee MLS companies use a licensed broker?

Yes. Only licensed brokers who are MLS participants can enter listings. The difference is whether you work with that broker directly or through another company.

Are referral fees bad for sellers?

Not necessarily. They are legal when properly licensed, but they are part of the cost, so it's fair to ask whether anyone is receiving one.

Is a marketplace the same as a referral company?

Not exactly. A marketplace like Houzeo sells listing plans and technology, and partner brokers place the listings. A referral company like Clever matches you with an agent and is paid by that agent. Both put another company between you and your listing broker.

How do I check an Alabama broker's license?

Use the Alabama Real Estate Commission's license lookup. Tracy Hood's license number is 84479-1.

Do I have to offer a buyer's agent commission in Alabama?

No. After the NAR settlement, buyer's agent compensation is negotiable and is not advertised on the MLS. You can offer it, decline it, or negotiate it in an offer.
